These Terms and Conditions constitute a legally binding agreement between you ("User," "you," or "your") and Bellavance Homes Nigeria ("Bellavance," "we," "us," or "our"), a real estate company duly registered under the laws of the Federal Republic of Nigeria, with its principal office at Ballevance Homes, Elpanthomath Park, 14B, Accra Street, Wuse zone 5, Abuja.
By accessing our website, mobile application, or engaging our services in any capacity, you agree to comply with and be bound by these Terms. These Terms apply to all visitors, registered users, prospective buyers, sellers, tenants, landlords, and any other persons who access or use our services.
If you are using our services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. In such cases, "you" refers to that entity.
Our Services
Bellavance Homes provides a range of premium real estate services in Nigeria, including but not limited to:
- Listing and marketing of residential and commercial properties for sale, rent, or lease
- Property search, discovery, and matching services for prospective buyers and tenants
- Professional property advisory, valuation, and investment consultation
- Off-plan property marketing and developer partnerships
- Property management services for landlords and investors
- Facilitation of property documentation, due diligence, and transaction support
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice where practicable. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.
User Obligations
By using our platform, you agree to:
- Provide accurate, current, and complete information during any registration or inquiry process
- Maintain the security of any account credentials and notify us immediately of any unauthorised access
- Use our services only for lawful purposes and in accordance with these Terms
- Refrain from uploading or transmitting any defamatory, obscene, fraudulent, or otherwise unlawful content
- Not attempt to gain unauthorised access to any portion of our platform or systems
- Not use our platform to send unsolicited communications or engage in any form of spam
- Not scrape, copy, or reproduce any content from our platform without prior written consent
You must be at least 18 years of age to use our services. By using our platform, you represent and warrant that you meet this minimum age requirement.
Any violation of these obligations may result in the immediate suspension or termination of your access to our services, without prejudice to any legal remedies available to us.
Property Listings & Accuracy
Bellavance Homes endeavours to ensure that all property listings, descriptions, photographs, floor plans, and pricing information are accurate and up to date. However, we cannot guarantee the accuracy or completeness of all listing information at all times.
- All prices displayed are indicative and subject to change without prior notice
- Property availability is subject to prior sale, let, or withdrawal without notice
- Square meterage, room dimensions, and plot sizes are approximate unless otherwise stated
- Photographs and renders may be illustrative and not representative of the exact unit
- Off-plan properties are subject to developer timelines and planning approvals
We strongly recommend that prospective buyers and tenants conduct independent due diligence, including physical inspections and engagement of qualified legal and financial advisors, before committing to any property transaction.
For off-plan and pre-construction properties, actual finishes, layouts, and delivery timelines may differ from those advertised. Bellavance Homes acts solely as a marketing intermediary and is not a party to any developer-buyer agreement.
Intellectual Property
All content on the Bellavance Homes platform — including but not limited to text, graphics, photographs, logos, icons, audio clips, digital downloads, data compilations, and software — is the property of Bellavance Homes or its content suppliers and is protected by applicable Nigerian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use our platform for personal, non-commercial purposes only. This licence does not include the right to:
- Reproduce, distribute, or publicly display any content from our platform
- Modify or create derivative works based on our content
- Use our brand name, logo, or trademarks without prior written consent
- Commercially exploit any content obtained through our platform
Any unauthorised use of our intellectual property may give rise to a claim for damages and/or constitute a criminal offence under Nigerian law.
Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our platform, you consent to the collection, use, and processing of your personal data as described in the Privacy Policy.
We are committed to complying with the Nigeria Data Protection Act 2023 (NDPA) and all applicable data protection regulations. Please review our Privacy Policy to understand how we collect, use, and safeguard your information.
Disclaimers
Our services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not guarantee that our platform will be uninterrupted, error-free, or free of viruses
- We do not verify the identity of all parties to property transactions facilitated through our platform
- We are not responsible for the conduct of third-party developers, landlords, or sellers
- Investment in real estate involves risk; past performance is not indicative of future results
- Any market analysis or investment commentary provided is for general information only and does not constitute financial advice
Bellavance Homes is a real estate marketing and advisory intermediary. We are not solicitors, financial advisors, surveyors, or engineers. Always engage qualified professionals for legal, financial, structural, and regulatory matters before completing any property transaction.
Limitation of Liability
To the fullest extent permitted by applicable Nigerian law, Bellavance Homes, its directors, officers, employees, agents, and affiliates shall not be liable for any:
- Indirect, incidental, consequential, special, or punitive damages arising from your use of our services
- Loss of profits, revenue, data, goodwill, or anticipated savings
- Losses arising from transactions entered into based on information obtained through our platform
- Interruption or cessation of our services, however caused
- Unauthorised access to or alteration of your data or communications
In any event, our total aggregate liability to you for any cause of action, regardless of the form of the action, shall not exceed the total fees actually paid by you to Bellavance Homes in the three (3) months preceding the event giving rise to the claim, or ₦100,000 (One Hundred Thousand Naira), whichever is greater.
Indemnification
You agree to indemnify, defend, and hold harmless Bellavance Homes and its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of, or inability to use, our services
- Your violation of any provision of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
- Any content you submit, post, or transmit through our platform
- Your violation of any applicable law or regulation
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising out of or relating to these Terms or your use of our services shall be resolved as follows:
The parties shall first attempt to resolve any dispute through good-faith negotiations within thirty (30) days of written notice of the dispute.
If amicable resolution fails, disputes shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act (Cap A18, Laws of the Federation of Nigeria 2004, as amended). The seat of arbitration shall be Abuja, Federal Capital Territory, Nigeria. The language of arbitration shall be English.
Notwithstanding the foregoing, either party may seek interim or injunctive relief from the courts of the Federal Capital Territory, Abuja, Nigeria.
Changes to These Terms
We reserve the right to amend these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this document and, where practicable, notify users via email or a prominent notice on our platform.
Your continued use of our services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must discontinue use of our services immediately.
